Officer Delegated Decisions

Purpose of committee

You will find decisions taken by Officers of the MCA who have the delegated authority to make decisions on behalf of the MCA or Thematic Board.

 

The Officer Scheme of Delegation is set out in Part 4F of the Constitution and section 101 of the Local Government Act 1972.

 

Under this provision the Head of Paid Service, Section 151 Officer, Monitoring Officer and Directors with delegated authority are each empowered individually to take any action which is required in the interests of the Authority where the effect of the decision is to:

 

              i.            Grant a permission or licence; or

            ii.            Affect the rights of an individual; or

          iii.            Award a contract or incur expenditure which, in either case, materially affects that relevant local government body’s financial position.

 

Where the decision to be taken is a Key Decision, the decision will be published on the MCA’s Forward Plan of Key Decisions 28 days in advance of the decision being made.
